In Meier v. D’Ambose, ___ N.J. Super. ___ (App. Div. 2011), the trial court dismissed the plaintiff’s negligence and wrongful death complaint. The plaintiff’s deceased brother died of smoke inhalation from a fire that occurred in the house that he was renting in Neptune City from the defendant. The issue presented to the Appellate Division was whether the defendant, who was the owner/landlord of the one-family home that the decedent was renting, had a duty to maintain, and thereby periodically inspect, the furnace in the house to prevent a dangerous condition. The Appellate Division held that the defendant had such a duty and, therefore, reversed the trial court’s decision.
