In New Jersey, under a triple net lease a commercial tenant is responsible for maintaining the premises, paying all utilities, paying taxes, and paying other charges related to the property. The landlord who leases the premises under a triple net lease does not have a duty to maintain the premises in those areas in which it has not retained control. In Ahlstrom v. TMC Properties, LLC, No. A-1115-09T1 (App. Div. September 30, 2010), the plaintiff sought to hold a landlord who had leased the premises under a triple net lease liable for his injuries, but the Appellate Division rejected his claim.
